Terms of Service
These terms govern your use of DataOZ, a reporting service operated from Canberra, Australia by dataoz.com.au (ABN 65 845 290 845) ("DataOZ", "we", "us"). By creating an account or using the service you agree to them. If you are signing up on behalf of a business, you confirm you have authority to bind that business.
1. The service
DataOZ ingests the sales and settlement files your retailers send you, cleans them, maps them onto a shared vocabulary, and presents a reconciled dashboard of gross sales, GST, commission, deductions and net payout across your retailers, with reports, exports and an API. We improve the service continually, and features may change; we will not remove a capability material to your plan without notice.
2. Accounts
Keep your login credentials confidential and tell us promptly at hello@dataoz.com.au if you suspect unauthorised access. You are responsible for activity under your account. One subscription covers one business (one tenant); each of your staff should use their own login.
3. Subscriptions and billing
- Plans bill monthly in advance, in Australian dollars, exclusive of GST, through Stripe.
- You can cancel at any time from your account or by email. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months, except where the Australian Consumer Law requires one.
- We can change prices with 30 days' written notice. A price change never applies mid-way through a period you have already paid for, and customers on a locked founding rate keep that rate for the full locked term. If you do not accept a new price, you can cancel before it takes effect and pay nothing further.
- If a payment fails we will retry and email you. If payment remains outstanding 14 days after the due date we may suspend access until it is settled.
4. Your data
The files you upload, the data synced from your Google Drive, and the cleaned records and reports we derive from them belong to you. You grant us a licence to store and process that data only as needed to provide the service, and the licence ends when your data is deleted. We never disclose your sales data to another customer, to your retailers, or to any third party except the processors named in our Privacy Policy. You are responsible for having the right to upload the data you give us.
5. Acceptable use
Use the service only for your own business data and only lawfully. Do not attempt to access another tenant's data, probe or overload our infrastructure, resell the service, or upload material that infringes someone else's rights. We may suspend an account that breaches this section, and we will tell you why.
6. Availability and support
We aim to keep DataOZ available at all times but do not promise uninterrupted service, and we may perform maintenance with notice where practical. Support is by email at hello@dataoz.com.au; we respond within one business day.
7. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, and to the extent the law allows: we are not liable for indirect or consequential loss, and our total liability for all claims arising out of the service in any 12-month period is capped at the fees you paid us in that period. This cap does not apply to loss we cause through fraud or wilful misconduct. DataOZ presents and reconciles the data your retailers produce; you remain responsible for your own commercial and accounting decisions.
8. Termination and data return
You can stop using the service and cancel at any time. After a subscription ends, you can export your data in spreadsheet form for 30 days. After that we delete your tenant's data from our production systems. We may terminate for material breach of these terms with 14 days' written notice if the breach is not remedied.
9. Changes to these terms
We may update these terms where the change is needed to reflect a change in the service, in law, or in our costs. We will email account holders at least 30 days before a material change takes effect. If you do not accept a change, you may cancel before it applies, and we will refund any period you have paid for but not used.
10. Governing law
These terms are governed by the laws of the Australian Capital Territory, and the courts of the ACT have non-exclusive jurisdiction over any dispute.
